Newair Giveaway Terms and Conditions

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

1. Sponsor: The Newair Giveaway (the “Promotion”) is sponsored by Newair, located at 6600 Katella Ave, Cypress, CA 90630 (“Sponsor”). This Promotion is not sponsored, endorsed, administered by, or associated with X Corp or any other social media platform.
   
2. Eligibility: The Promotion is open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age at the time of entry. Employees, officers, and directors of Newair, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and their immediate family members (spouse, parents, siblings, children) and household members are not eligible to participate. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.
   
3. Promotion Period: The Promotion begins on August 11, 2025, at 11:00 AM PST and ends on August 14, 2025, at 11:59 PM PST (the “Promotion Period”). Entries submitted before or after the Promotion Period will not be eligible. Sponsor’s clock is the official timekeeping device for the Promotion.
   
4. How to Enter: To enter, participants must complete the following steps during the Promotion Period via X:
   1. Follow the official Newair account (@NewairUSA) on X. 
   2. Repost the official Promotion post from @NewairUSA. 
   3. Tag two (2) friends in the comments of the official Promotion post from @NewairUSA. 
      1. Each participant may submit one (1) entry per X account. Multiple entries from the same person or account will be disqualified. 
      2. Entries must comply with X’s Community Guidelines and Terms of Service. 
      3. Entries that are incomplete, illegible, fraudulent, or generated by bots, scripts, or other automated means will be disqualified. 
      4. No purchase is necessary to enter or win.
         
5. Prize Description: One (1) winner will receive a Newair Beverage Fridge (Newair 126-Can Beverage Refrigerator, approximate retail value (ARV): $384.99). 
   1. The prize is non-transferable, non-assignable, and non-redeemable for cash, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. 
   2. All federal, state, and local taxes, duties, or other costs associated with the prize are the winner’s responsibility.
      
6. Winner Selection and Notification: One (1) winner will be randomly selected from all eligible entries received during the Promotion Period using a third-party tool (WASK). The drawing will take place within 24 hours of the Promotion Period’s end. 
   1. The potential winner will be notified via direct message (DM) on X and must respond within 48 hours to claim the prize. The potential winner may be required to provide proof of U.S. residency, complete a prize claim form, and/or sign an affidavit of eligibility and liability/publicity release. 
   2. If the potential winner does not respond within 48 hours, fails to meet eligibility requirements, or declines the prize, an alternate winner may be selected at Sponsor’s discretion. 
   3. The winner’s X handle may be announced on Newair’s X account and/or website, subject to their consent.
      
7. Publicity: By entering, participants grant Sponsor and its affiliates permission to use their name, likeness, X handle, and/or comments for promotional purposes in any media worldwide, without further compensation, unless prohibited by law.
   
8. General Conditions: Sponsor reserves the right to cancel, suspend, or modify the Promotion if fraud, technical failures, or any other factor beyond Sponsor’s control impairs the integrity of the Promotion, as determined by Sponsor in its sole discretion.
   1. Sponsor is not responsible for lost, late, incomplete, damaged, stolen, or misdirected entries; errors or malfunctions of any kind, whether human, mechanical, electronic, or otherwise; or any injuries, losses, or damages resulting from participation in the Promotion or receipt/use of the prize. 
   2. Participants agree to release, indemnify, and hold harmless Newair, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or liabilities arising from participation in the Promotion or acceptance, use, or misuse of the prize.
      
9. Limitation of Liability: To the fullest extent permitted by law, Sponsor’s liability for any claims arising from the Promotion is limited to the ARV of the prize. In no event shall Sponsor be liable for any special, incidental, consequential, or punitive damages.
   
10. Privacy: Personal information collected during the Promotion will be used solely for the purpose of administering the Promotion and in accordance with Newair’s Privacy Policy, available at [https://www.newair.com/pages/privacy-policy]. By entering, participants consent to the collection and use of their information as described.
    
11. Governing Law: The Promotion is governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
    
12. Winner List: To request the winner’s name (available after August 20, 2025), send a self-addressed, stamped envelope to Newair, Attn: Giveaway Winner List, 6600 Katella Ave, Cypress, CA 90630. Requests must be received by September 30, 2025.
